Welcome to jonathandickinson.ca (the "Site"). The Site is owned and operated by Jonathan Dickinson Enterprises Inc. ("JDE Inc.", "we", "us", or "our"), a corporation incorporated under the laws of Canada and located at 78 Livingston Ave, Grimsby, ON L3M 1L5. By accessing or using our Site, you ("you" or the "user") agree to be bound by these Terms and Conditions (the "Terms").
PLEASE READ THESE TERMS CAREFULLY.
Your use of this Site signifies and constitutes your acceptance of and agreement to be bound by these Terms. . By placing an order or registering for a course through our Site, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must cease use of the Site.
1. General Terms
These Terms and our Privacy Policy contain the entire agreement between you and JDE Inc. relating to your use of the Site and supersede all prior or concurrent communications between us.
The Site is intended for persons who are at least 18 years of age. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian.
We do not knowingly collect personal information from children under the age of 13.
2. Acceptance of Terms
By using this Site, you affirm that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) and that you have the legal capacity to enter into and be bound by these Terms.
3. Use of the Site
You may use the Site for lawful purposes only. You agree not to use the Site:
• In any way that violates any applicable local, provincial, federal, or international law or regulation;
• To copy, modify, adapt, translate, or create derivative works of any part of the Site;
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent;
• To impersonate or attempt to impersonate JDE Inc., a JDE Inc. employee, or any other person or entity;
• To share, distribute, or resell course materials, ebooks, or audiobooks purchased through the Site;
• To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
4. Products and Services
We offer physical books, digital products (ebooks and audiobooks), and online courses through this Site. We make reasonable efforts to ensure that product descriptions, images, and pricing are accurate and up to date. However, errors may occasionally occur.
We do not guarantee that all product descriptions, images, pricing, or other content on the Site are accurate, complete, current, or error-free. If we discover an error relating to a product or an order, we reserve the right to correct the error and, where applicable, cancel or refuse the order. In such cases, any amounts paid will be refunded in accordance with applicable law.
Product Types:
Physical Books: Printed books that will be shipped to your address.
Digital Products: Ebooks and audiobooks delivered digitally via download link or email.
Online Courses: Course registrations providing access to online educational content, which may include videos, written materials, and other digital resources.
Product Availability:
All products and course offerings are subject to availability. We reserve the right to discontinue any product or cancel any course at any time. If a product you have ordered becomes unavailable or a course is cancelled, we will notify you and offer a full refund.
Pricing and Currency:
Prices are displayed in either Canadian Dollars (CAD) or United States Dollars (USD) as indicated at checkout. Prices are subject to change without notice. Applicable sales taxes (such as HST, GST, or state/local sales tax) will be calculated and added at checkout based on your location. We are not responsible for any currency conversion fees charged by your bank or payment provider.
License and Usage Rights:
When you purchase digital products (ebooks, audiobooks) from our Site or register for our courses, you are granted a non-exclusive, non-transferable, personal license to access and use the materials for your own personal, non-commercial use only. You may not:
• Share, distribute, sell, rent, or lease any digital products or course materials;
• Copy, reproduce, or create derivative works from the materials;
• Remove any copyright, trademark, or other proprietary notices;
• Use the materials for any commercial purpose or public display.
Disclaimers:
Our books, digital products, and courses may contain information about psychedelic substances, medical topics, and other specialized subjects. All content is intended for educational and informational purposes only and does not constitute medical, legal, financial, or professional advice. The content, views, and opinions expressed are those of the author and do not necessarily reflect the views of JDE Inc. You should consult qualified professionals before making any decisions regarding your health, legal matters, or other important personal matters.
5. Orders and Payment
Order Acceptance:
Placing an order on our Site constitutes an offer to purchase the product(s) or register for course(s) in your cart. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in pricing or product information, or issues identified by our fraud detection systems. If we decline your order after payment has been processed, we will refund the full amount.
Payment Processing:
We accept payment via credit card, processed securely through Stripe. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the total amount of your order (including applicable taxes and shipping fees ) to that payment method.
We do not store your full credit card details. Payment information is processed securely by Stripe in accordance with PCI-DSS standards. Please review Stripe's privacy policy at https://stripe.com/privacy.
Order Processing and Delivery:
• Physical Books: Orders are typically processed and shipped within 48 hours (2 business days) of payment confirmation. You will receive an order confirmation email upon successful payment, and a shipping confirmation email with tracking information once your order has been dispatched.
• Digital Products: Ebooks and audiobooks will be delivered immediately upon payment confirmation via download link sent to your email address. Please check your spam folder if you do not receive the link within 15 minutes.
• Course Access: Upon successful registration and payment, you will receive an email with instructions for accessing your course materials. Course access begins on the scheduled start date indicated at the time of purchase.
6. Shipping and Delivery (Physical Products Only)
Shipping Locations:
We currently ship physical books to addresses within Canada and the United States only. Shipping options and costs will be calculated at checkout based on your location and the items in your order.
Shipping Costs:
Shipping costs are the responsibility of the customer and will be clearly displayed at checkout before you complete your purchase. Shipping fees are non-refundable except in cases where we have shipped you a defective or incorrect item.
Delivery Timeframes:
Estimated delivery times vary based on your location and the shipping method selected at checkout. Delivery estimates are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing (for international shipments), weather, or other factors beyond our control.
Risk of Loss:
If your package is lost or damaged in transit, please contact us immediately and we will work with the carrier to resolve the issue.
7. Returns, Refunds, and Cancellations
Our refund and return policies vary depending on the type of product or service purchased:
A. Physical Books
Due to the nature of books as printed materials, we accept returns only for defective, damaged, or incorrect items. Books must be in resalable condition (unopened shrink wrap, if applicable, and no marks, writing, or damage).
If you receive a defective, damaged, or incorrect book, you may return it within 30 days of delivery for a full refund or replacement. To initiate a return, please contact us at jonathan@jonathandickinson.ca with your order number, a description of the issue, and photos of the defect or damage if applicable.
If the return is due to our error (defective, damaged, or incorrect item), we will provide a prepaid return shipping label and refund your purchase price and original shipping costs. Otherwise, customers are responsible for return shipping costs and original shipping fees are non-refundable.
We do not accept returns for change of mind or buyer's remorse on physical books. Please ensure you are committed to your purchase before completing checkout.
B. Digital Products (Ebooks and Audiobooks)
SALES OF DIGITAL PRODUCTS ARE FINAL. Due to the nature of digital products, we cannot accept returns or offer refunds once the download link has been accessed or the file has been downloaded. By completing your purchase of a digital product from our Site, you consent to immediate delivery of the digital product and acknowledge that your right to cancel may be lost once the download begins. Exception: If you experience technical issues accessing or downloading your digital product that we are unable to resolve, we may offer a refund at our sole discretion. Please contact us at jonathan@jonathandickinson.ca within 48 hours of purchase with details of the technical issue.
C. Course Registrations
You may cancel your course registration and receive a full refund up until the course start date. Once the course has begun (i.e., on or after the scheduled start date), no refunds will be provided, regardless of whether you have accessed the course materials.
To request a cancellation and refund before the course start date, please contact us at jonathan@jonathandickinson.ca with your order number. Refunds will be processed to your original payment method within 7-10 business days.
Course Cancellation by Us: If we cancel a course for any reason, you will receive a full refund of your registration fee, regardless of whether the course has started.
General Refund Processing:
Once we approve your refund request (where applicable), we will process your refund to the original payment method within 7-10 business days. Please note that refunds may take additional time to appear on your account depending on your bank or payment provider.
8. Course Policies
Course Access:
Upon registration, you will receive access to the course materials for the duration specified in the course description. Access may be time-limited (e.g., 6 months, 1 year) or permanent, depending on the specific course offering.
Course Materials:
Course materials (including videos, PDFs, worksheets, and other content) are for your personal use only and may not be shared, distributed, reproduced, or used for any commercial purpose. We reserve the right to terminate your course access if you violate these terms.
Course Changes:
We reserve the right to modify course content, schedules, instructors, or format at any time. We will make reasonable efforts to notify registered participants of material changes. If you are not satisfied with substantial changes made after you register, you may request a refund if the course has not yet started.
9. Intellectual Property
, is the property of JDE Inc., and the author Jonathan Dickinson, owns all content on this Site - including but not limited to text, graphics, logos, images, audio, video, software, course materials, ebooks, and audiobooks - and all intellectual property rights therein. All such content is protected by copyright law .
JDE Inc. and our brands, and any current or future affiliated or related companies and brands (collectively, “Affiliates”), trademarks and design marks (collectively, the "Marks"), are trademarks or registered trademarks of JDE Inc. and/or its Affiliates, and the property thereof. All other products, brand and company names and logos used, displayed or referenced on the Site may be the trademarks or registered trademarks of their respective owners. Any use of any trademarks, including the Marks, without the express written consent of the owner of the trademark is strictly prohibited.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download (except as expressly permitted for digital products you have purchased), store, or transmit any material on our Site without our prior written consent, except for your own personal, non-commercial use as expressly permitted by your purchase license.
All published works, digital products, and course materials are protected by copyright. Unauthorized reproduction, distribution, or public display of any part of our content is prohibited and may result in legal action.
10. Disclaimers and Limitation of Liability
Disclaimer of Warranties:
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR OUR COURSES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
PHYSICAL BOOKS ARE SOLD "AS IS" WITH NO WARRANTY BEYOND STANDARD PRINTING QUALITY. DIGITAL PRODUCTS AND COURSES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY REGARDING COMPATIBILITY WITH YOUR DEVICES, INTERNET CONNECTION, OR SOFTWARE. WE DO NOT GUARANTEE THAT THE INFORMATION IN OUR PRODUCTS OR COURSES WILL MEET YOUR SPECIFIC NEEDS OR EXPECTATIONS.
Limitation of Liability:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JDE INC., ITS AFFILIATES, SUBSIDIARIES, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, SUCCESSORS, LICENSORS OR ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SITE, PRODUCTS, OR COURSES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY ERRORS OR OMISSIONS IN ANY CONTENT; (D) YOUR USE OF OR RELIANCE ON THE CONTENT OF ANY PRODUCTS OR COURSES; OR (E) ANY TECHNICAL ISSUES PREVENTING ACCESS TO DIGITAL PRODUCTS OR COURSES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR COURSE, OR CAD $100, WHICHEVER IS LESS.
11. Indemnification
You agree to indemnify, defend, and hold harmless JDE Inc. (including its officers, directors, agents, affiliates, employees, representatives and third party service providers) from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from (a) your use of our Site, products, or courses; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any unauthorized sharing or distribution of our digital products or course materials.
12. Third-Party Services
The Site uses third-party payment processing through Stripe. We have no control over, and assume no responsibility for, the privacy policies or practices of Stripe.
13. Governing Law and Dispute Resolution
These Terms and any disputes arising out of or related to the use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Binding Arbitration:
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration in accordance with the Arbitration Act, 1991 (Ontario) or the applicable federal arbitration rules. The arbitration shall be conducted in English in the city of Hamilton, Ontario, Canada, or virtually at the parties' mutual agreement.
Each party shall bear its own costs of arbitration, and the arbitrator's fees shall be shared equally unless the arbitrator determines otherwise. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
Exceptions to Arbitration:
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Class Action Waiver:
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Termination
We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Site, our digital products, or courses at any time, with or without notice, for any reason, including but not limited to a breach of these Terms (such as unauthorized sharing of materials). Upon termination, your right to use the Site and access purchased materials will immediately cease. No refunds will be provided for terminations due to your violation of these Terms.
15. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the intent of the original provision.
